Mr. Pownall,
Our being on the same commission precludes debating this subject, because it is still on the table. I can, however, make a comment about old business, which is your reference to my postponing the Basin Park Hotel lot twice, which makes me sound like I'm dragging this issue out.
The first time I postponed it was because Mr. Moyer didn't come to the meeting as arranged by the chair. I didn't want to discuss the subject from only my point of view, so I gave him a second chance.
Marion Chrysler, the Building Inspector didn't show up either, and I postponed the issue to give her a second chance.
Neither party came to the meetings.

Barbara...you aren't listening again. and putting your slant on things. I said I agree with your comments...to a point...I then said....Planning is not, by code a code enforcement entity...therefore it is NOT a Planning Commission issue as it stands....
I'm out of here too....DONE with it!!!

That is the point. Where <strong>is</strong> the application? Obviously there was much discussion, and several inspections. What was that all about?

Perhaps you are saying that a resident can build a parking lot without an application?

Or an inspection?

Without following the codes?

Okay, can I build a parking lot as I please so long as the Mayor's son-in-law (the Chief of Police) says it is safe?

I'm off. This discussion turns on the absurd proposition that if Planning has no app, compliance is not necessary. I absolutely will not continue to clog up comments with chop logic like yours, Ken.

Go on and post the last word. Then, that is it.

'Bye 'bye.

The issue is pure and simple. Where is the permit approving the lot?

<strong> The lot was never approved. Period</strong>.

Equivocate as you will, but answer the one simple question. When did Planning approve the lot?

If you have additional information to post, your comments will be approved. If not..../CUT

Barbara
Since my resources are limited, please provide for me where, in the code...state or Municipal , that allows the Planning Commission to take on the role of Code enforcement? If it's there, I'll stand corrected and press forward.

My apologies for name calling in the past. I was taking out my frustration on you.
Again...respecting each others right to disagree is paramount and apparently a moot point.
Thank you for posting my views.

<a href="http://skepdic.com/falseanalogy.html" rel="nofollow">Bad argument by analogy</a> this time, Ken, when you compare yourself to someone giving tickets without the authority to do so. False argument. As one logician says, it's like comparing apples and pears.

You have a corrupt Building Official, who has told me that she saw no reason to call the lot out of compliance, even though she could not turn her truck around to drive out frontwards when she was asked to try it.

Further, the Commission does address issues of compliance. To say that it does not have the authority to do so is to render meaningless the commission you so proudly serve.

You don't really want to do that, do you? Or do you?

You said you absolutely were not going to run for Council at a Council workshop. I find that somewhat suspicious in light of your oh-so-polite response here compared to the past when you called the publisher of ES Folk a brown turd, tried to interfere in freedom of the press by <a href="http://www.lovelycitizen.com/story/1300935.html" rel="nofollow">complaining to our host WordPress </a> [scroll down to the bottom of the letters to the editor] to get us to stop reporting the truth, by committing libel in saying we have said things that we absolutely and positively have not, and etc.!

True, then-Mayor Harrison asked you to put in an app for Planning. Whoo! boy! She made a terrible mistake, and you'll get no mileage here for mentioning it.

Barbara...further clarification of my position...with the understanding we respect each others right to disagree....If the appropriate authories should determine the parkng lot to be out of ompliance...issue the owner a letter stating "until it is brought into compliance, this parking lot is closed" I have no problem with that. My position is not one of irrelevant appeals as you stated but of forthright authority. Until I can be shown where we, the Planning Commission, have carte blanche authority to attempt to do others jobs...I'm sorry..I'd be out of bounds...It would be like me standing on Main Street with a speed gun and a ticket book and issuing speeding tickets because I feel the driver is "out of compliance" with the law. We, as a commission, have some many tasks that ARE within our purview that aren't getting done and that frustrates me. I have no hidden agenda. I stood in my front yard and told then Mayor Harrison just that when she asked me to apply for Planning.. I have entered into every decision that I have considered as to relevance, legality, good business sense and what is good for the community. In some cases personal opinions must be put to the side and go with the best response to the situation. Again...thank you for respecting my view.

Thank you Barbara for your summation of the situation that I am in total agreement with. However, until there is an application before the commission, I am at a loss at what authority we (Planning Commission) have to just jump in and yell CODE VIOLATION. As for your final comment...I am busy...getting ready for and going to meetings that don't meet because we don't have a quorum. Any suggestions? Thanks
