Rumor Control: Plaintiffs Acted Separately in Suit against Mayor Joy

Plaintiffs Rae Hahn, Kathy Harrison, Eric Scheunemann and Ernst Schrader filed suit against Mayor Dani Joy of Eureka Springs in their role as individuals, not in their role as members of Council.

Rumor has it that they filed as “councilmen [sic].”

Plaintiffs Filed in their own Person

Plaintiffs filed in their person, as individuals affected by what they contend is an illegal veto by the Mayor of Matsukis’ election to Council. Matsukis was duly and properly elected to replace Councilwoman Charlotte Buchanan, who had resigned.

As noted in the complaint, Matsukis, Harrison, Hahn, Scheunemann and Schrader each filed as “an individual.” The complaint, brief, and other relevant papers are available through the Carroll County Circuit Court in Eureka Springs.

Plaintiffs Met Separately with Their Attorney

ES Folk has also been informed that each plaintiff traveled to Fayetteville separately, and met separately with attorney Charles Kester to sign court documents specifically so they would not be in violation of Arkansas’ Freedom of Information Act (FOIA). FOIA requires that that the media be notified of meetings in which city business is conducted by city officials.
